Legal guarantee of conformity
What the guarantee is
Under arts. 128–135 of the Codice del Consumo (d.lgs. 206/2005), we are liable to you for any lack of conformity that exists at the moment of delivery and becomes apparent within 2 years of that date.
A garment conforms when it matches the description and the specification published on its product page, is fit for the purpose garments of that kind are normally used for, and shows the quality and performance you can reasonably expect given what we have said about it.
This guarantee is given by us as seller and is provided free of charge. No clause of our terms limits it, and no separate commercial warranty is offered or needed.
The first year is presumed
Any lack of conformity that becomes apparent within one year of delivery is presumed to have existed at delivery, unless that is incompatible with the nature of the goods or the nature of the defect. In practice, for the first twelve months you do not have to prove anything about when the fault arose. After that year the presumption ends but the guarantee continues to the full 2 years.
What you can ask for
Where a garment does not conform you are entitled, at no cost, to have it brought into conformity — by repair or by replacement, at your choice, unless the remedy you choose is impossible or disproportionate compared with the other.
- Repair or replacement is carried out within a reasonable time and without significant inconvenience to you. We pay the return postage.
- If neither remedy is possible, if we fail to complete it in reasonable time, or if the defect returns, you may ask for a proportionate price reduction or terminate the contract and be refunded.
- You cannot terminate for a defect that is only minor, but you can still ask for the price reduction.
- Where a garment is replaced, the guarantee period on the replacement runs afresh from the date the replacement is delivered.
What counts as a defect — and what does not
Covered
- Seams that open along the stitching line in normal wear
- A collar or cuff rib that does not recover to its measured shape
- Holes, thin patches or runs present on arrival or appearing without cause
- Colour that transfers or fades far beyond what the care instructions would predict
- Measurements outside the published tolerance for that size
- Fibre composition, weight or origin that does not match what the page states
Not covered
- Shrinkage within the figure published on the product page. Every style states its measured shrinkage and shows a second size table for what it will measure after the first wash.
- Pilling consistent with the grade published for that style. The grade and the test that produced it are on every page that has one.
- Damage from washing hotter, tumble drying or bleaching contrary to the care instructions sewn into the garment
- Normal wear: gradual thinning, softening and loss of surface over years of use
- Damage from alteration, snagging, or accidents after delivery
Shrinkage and pilling are properties of knitted cotton, which is exactly why we measure them and print the numbers before you buy rather than describing the fabric as durable and leaving it there.
How to claim
- Write to support@fashionabbigliamento.shop with your order reference, which piece it is, and a photograph of the problem. A photograph usually settles it immediately.

- We acknowledge on the day the claim arrives and tell you what happens next within one working day.
- Where the piece needs to come back to us, we send a prepaid label. You never pay postage on a guarantee claim.
You do not need the original packaging and you do not need a paper receipt — the order reference or the email address you ordered with is enough for us to find the order.
How this relates to withdrawal
The 14-day right of withdrawal is for changing your mind and has its own exceptions — notably garments worn against the skin. This guarantee is for goods that are faulty or not as described, lasts 2 years, and has no such exception: a faulty camisole is covered whether it has been worn or not.
